The Lucknow bench of the Allahabad High Court, hearing a public interest litigation on traffic congestion filed by advocate Suraj Singh Visen, directed the Uttar Pradesh government on Monday, 2 November 2026, to decide within four weeks whether fresh e-rickshaw registrations should be restricted in Lucknow and in other cities where the numbers exceed what the roads need. The bench of Justices Alok Mathur and A K Chaudhary was told that about 1.33 lakh e-rickshaws operate in Lucknow. It also made a point that matters to every buyer of a second-hand toto: the Centre's waiver of the registration fee for battery vehicles does not waive the statutory requirement to register. The matter comes back on 9 December 2026 with a compliance report. The decision is the state's to make. Whatever it decides, a used e-rickshaw in UP is now either a registered vehicle with a number that may soon be scarce, or an unregistered one that may never get a number at all. The Rs. 99 RC check tells you which one you are looking at.

What the Court Said on 2 November

The order, as reported by PTI and the legal press, does four things. First, it asks the state to examine whether limiting fresh registrations under the Motor Vehicles Act is feasible in areas where e-rickshaw numbers exceed requirements, and to decide within four weeks. Second, it notes that a 12 May 2022 order barring e-rickshaws from several Lucknow roads is not being effectively enforced, and asks the Special Investigation Team to ensure compliance and to examine whether similar restrictions suit other areas. Third, wherever movement is restricted, alternative routes must be provided so commuters are not stranded. Fourth, IIT (BHU) Varanasi is to carry out an independent traffic assessment of the Polytechnic to Kamta to Chinhat stretch, with proposals to follow.

The figure of 1.33 lakh is the number placed before the bench this month. When the same PIL was heard in August 2026, the court was told about 80,000 e-rickshaws ran in the city, so either the count has been refined or the fleet has grown fast; the sources do not say which. What is not in doubt is the direction of travel. In November 2025, striking down an order that limited new e-rickshaw registrations in Lucknow to permanent residents, a different bench of the same court had suggested that capping registrations in a given year, or impounding vehicles without valid fitness certificates, would be lawful alternatives. The state told the court in that case that more than 70 per cent of e-rickshaw and e-auto owners in Lucknow had not obtained fitness certificates. The 2 November order picks up the first of those alternatives and gives the state a deadline.

Why a cap has to come from the state, not the RTO. In April 2024 the Allahabad High Court quashed a Mathura ARTO notification that had banned registration of new e-rickshaws and e-autos in Mathura and Agra. The court held that Rule 178 of the UP Motor Vehicle Rules 1998, which lets authorities restrict speed or the use of vehicles on particular roads, does not confer a power to refuse registration. A freeze, if it comes, will need a proper legal basis from the government, which is why the court has asked the government rather than the registering authority to decide.

Fee Exempt Is Not Registration Exempt

The line in the order that should be pinned to every e-rickshaw dealership wall is the one on fees. In 2021 the Ministry of Road Transport and Highways notified the Central Motor Vehicles (Sixteenth Amendment) Rules, 2021, exempting battery-operated vehicles from the fee for the issue or renewal of a registration certificate. The idea was to encourage electric mobility. It removed a fee. It did not remove the duty. Section 39 of the Motor Vehicles Act 1988 still bars anyone from driving, or permitting to be driven, a motor vehicle in a public place unless it is registered, and Section 2A of the Act, inserted in 2015, brings e-carts and e-rickshaws, three-wheeled battery vehicles of up to 4,000 watts carrying passengers or goods for hire, within the Act. The court said so in plain terms: the Centre's exemption from registration fees does not exempt e-rickshaws from the statutory requirement to register before they run on the road.

That matters because "no fee" has been misread for years as "no registration", and the result is a large population of totos that have never seen an RTO. The scale of it nationally, and why two identical-looking units can be a registered vehicle and an unregistered one, is covered in our piece on the 4.75 lakh e-rickshaws estimated to run without registration, so we will not repeat it here. In UP specifically, the state's April 2025 enforcement drive ended with more than 11,000 e-rickshaws seized across the month and, by the government's own count, thousands of challans issued specifically for want of registration. Reports from that drive describe the usual routes to an unregistered toto: units assembled in local workshops from old parts and sold at roughly half the price of a type-approved vehicle, which cannot be registered because the documents a first registration needs do not exist; units sold by a dealer on a promise that "the number will come", with the buyer never going back; and units bought second-hand from a driver who never had papers to begin with.

Battery lessors now ask for the RC too. In October 2025 the Allahabad High Court's Lucknow bench, following a Delhi High Court ruling in the same company's case, allowed a lithium-ion battery lessor to reclaim its batteries from impounded unregistered e-rickshaws, on the footing that the lessor would supply batteries only to owners who could show valid registration and fitness. If the finance houses and battery companies will not deal with an unregistered unit, a buyer who pays for one is the only person left carrying its risk.

What a Freeze Would Do to Prices

Delhi is the worked example. The capital resumed e-rickshaw registration in May 2026 with a one-vehicle-per-licence condition, and in October published a draft scheme capping the fleet at 2.5 lakh with a two-year compliance certificate tying one vehicle to one driver. We covered what each rule means for a used buyer in the one-per-licence piece and in the draft-scheme piece. The pattern they describe is simple. When a city stops or slows fresh registrations, an e-rickshaw that already holds a number is the only lawful way to put one more vehicle on that city's roads. The number acquires a value of its own, separate from the vehicle, the battery and the body. Sellers of registered units get a stronger hand. Buyers of unregistered units lose the one route they had to becoming legal, because a first registration of a vehicle that was sold without papers is hard today and may be impossible under a cap.

In Lucknow, three outcomes are possible after the four weeks. The state may restrict fresh registrations in Lucknow and a list of other cities; it may set an annual ceiling rather than a stop; or it may decline to restrict and instead tighten fitness and route enforcement, which the court has already asked the SIT to do. Under the first two, registered units in those cities appreciate against unregistered ones. Under the third, the enforcement push does the same thing more slowly, because an unregistered toto becomes harder to run for a living. It is hard to see an outcome in which an unregistered e-rickshaw bought today is worth more in December than it is now.

The lesson for a buyer is not to avoid used e-rickshaws. It is to pay the registered-unit price only for a registered unit, and to confirm registration from the record rather than from a laminated photocopy. Our full buyer checklist for used e-rickshaws and e-autos covers battery, motor, controller and permit in depth; the section below is about the one document a freeze makes decisive.

What the Rs. 99 RC Check Shows on a Three-Wheeler

Type the registration number from the plate or the RC into the Vahan Verify page. The report reads the VAHAN database and returns the fields below. The right-hand column is what each field means on an e-rickshaw in particular, where the questions differ from a car.

RC FieldWhat It Tells You on an E-RickshawWhat to Do
Record found / not foundNo record for a number the seller gave you means the vehicle is not registered, the number is made up, or it belongs to another vehicle.Stop. Read our tip on why a number returns no record before you go further.
Vehicle classShould read as an e-rickshaw or e-cart (passenger or goods). A two-wheeler or car class against a three-wheeler plate means a cloned number.Walk away.
Maker and modelThe type-approved manufacturer and model. A workshop-assembled unit will not match any approved model.Match the name on the body, the chassis plate and the record.
Chassis and engine or motor numberShown in part. On an e-rickshaw the chassis plate is usually under the driver's seat or on the front frame.Read it off the vehicle and compare the visible digits.
Registration date and RTOThe vehicle's real age and where it is registered. A Lucknow buyer with a Barabanki or Unnao registration will need a transfer and, if a freeze comes, may find the city's RTO reluctant.Prefer a unit registered in the district where it will run.
Owner serial and name patternHow many hands the vehicle has passed through and whether the seller is the person on the record. Fleet operators often hold a dozen units in one name. The registered owner, not a driver, signs your Forms 29 and 30.
Hypothecation / financierMost new e-rickshaws are bought on finance from a bank or NBFC. A lender still on the RC means the loan may be open, and the vehicle cannot be transferred until it is closed and Form 35 is filed.Ask for the closure letter and NOC, or have the seller clear it first. Our tip on hypothecation explains the process.
RC statusActive is what you want. A blacklisted, suspended or cancelled entry on an e-rickshaw usually follows a seizure, an accident case or a stolen-vehicle report.Walk away, or run the Rs. 99 blacklist check for the detail.
Fitness validityCommercial three-wheelers need a fitness certificate; the state told the High Court most Lucknow e-rickshaw owners did not hold one. An expired fitness is a seizure risk under current enforcement.Price the fitness test in, and insist on seeing the vehicle pass before full payment.
Insurance validityCommonly lapsed on a toto. Driving without third-party cover is an offence, and a lapse makes a claim after an accident impossible.Renew in your name on the day of transfer.
Pending challans (Full Report, Rs. 149)Route-ban challans from the 2022 Lucknow restrictions, overloading, and no-fitness challans all sit against the number.Clear them, or deduct them from the price.

Two things the record will not show, and the inspection must: the battery and the permit. A lithium-ion pack is the single most expensive part of an e-rickshaw and may be leased rather than owned, in which case it is not the seller's to sell; ask for the purchase invoice or the lease agreement in the seller's name, and check the pack's date code against the registration date. Permit requirements for e-rickshaws vary by state and by district, and in UP several districts run route-based systems; our tip on the auto and e-rickshaw permit check sets out what to ask the RTO. On a three-wheeler these two questions come up far more often than on a car, so ask them before you pay rather than after.

Checklist: Buying a Used E-Rickshaw in UP This Month

  1. Get the registration number first. From the plate, the RC and the insurance paper, all three matching. A seller who offers only a chassis number, or says the number "is being issued", is selling an unregistered vehicle. Pay the unregistered price or do not pay at all.
  2. Run the Rs. 99 RC check from home. Confirm the record exists, the class is a three-wheeler, the maker matches the body, the status is active, and read the financier line. Rs. 149 adds pending challans. Do this before the test ride, not after an hour of negotiation.
  3. Match the chassis plate to the record. Lift the driver's seat or find the front-frame plate. Digits that have been ground and restamped, or a plate that is riveted over fresh paint, end the conversation.
  4. If a lender shows, get the loan closed before you pay the balance. Closure letter, NOC and Form 35 signed by the seller and the financier, then an application to the RTO. Run the check again after a fortnight to confirm the financier line is blank.
  5. Ask who owns the battery. A leased pack goes back to the lessor; the vehicle you are buying may be a shell without it. Read the invoice or lease agreement, note the pack's date code, and ask for a full charge-and-range demonstration on a route you choose.
  6. Check fitness and insurance dates, and price the gap. An expired fitness means an ATS visit before the vehicle can earn; an expired policy means a renewal before it can move. Both are cheap compared with a seizure.
  7. Ask the RTO about the permit and any route restrictions in writing. The 12 May 2022 Lucknow order bars e-rickshaws from a list of major routes, and the court has just asked for it to be enforced. A unit whose only earning route is a barred one is worth less than its number suggests.
  8. Complete the transfer in your name and confirm it. Forms 29 and 30 signed by the registered owner, submitted within the statutory window, then the Rs. 99 check again after two to three weeks to see your name and the new serial. Until that happens, the previous owner's challans and the vehicle's liabilities still point at them, and the vehicle is still legally theirs.

If the state announces a freeze while you are mid-deal: a vehicle already in the VAHAN record is unaffected; transfers of registered vehicles continue. A vehicle awaiting its first registration is the one that may be stranded. If the seller's answer to "where is the RC?" is "it is coming", the four-week clock is now your problem too.

Looking at a used toto in Lucknow, Kanpur, Agra or Ghaziabad?

Type the registration number and read the official record: class, maker, chassis, owner serial, financier, fitness, insurance and RC status. Rs. 99 for the RC check, Rs. 149 with pending challans.

What This Means for Used E-Rickshaw Buyers and Sellers

For buyers in Uttar Pradesh, the next five weeks are a window in which the price of a registered e-rickshaw has not yet caught up with what a freeze would make it worth. That window rewards the buyer who confirms the number from the record and penalises the one who pays a registered price for a vehicle with a photocopy and a promise. Outside Lucknow, the order's wording covers "other cities" where numbers exceed need, so the same logic applies in Kanpur, Agra, Ghaziabad, Varanasi and Prayagraj. Buyers who want a listing with the record already attached can browse verified listings in Lucknow, where every vehicle has been checked against the VAHAN database before going live.

For sellers, a registered e-rickshaw with an active RC, no lender and a live fitness certificate is a better asset this month than it was last month, and the way to realise that is to put the record in front of the buyer. A verified listing on VahanBazaar costs Rs. 99, is cross-checked against the VAHAN record so the registration number, class and status are visible to buyers, and on average draws about 3x more buyer enquiries and sells around 40 per cent faster, based on VahanBazaar listings data. VahanBazaar lists three-wheelers as well as cars. If the loan is still open or the fitness has lapsed, fix those before listing; our guide to selling a used auto or e-rickshaw sets out the paperwork in order. A seller who is holding an unregistered unit should be honest that it is one, price it accordingly, and understand that the pool of buyers willing to take that risk is about to get smaller.

This article is general information and not legal advice. The 2 November 2026 order is reported from PTI and legal-press accounts; the state government's decision, the scope of any restriction and the cities covered are not yet known and may differ from the possibilities discussed here. Registration, permit and fitness rules for e-rickshaws differ between states and districts; confirm them with your RTO before buying, selling or transferring a vehicle.

Pay for a Number Only After You Have Read It

The VAHAN record shows whether an e-rickshaw is registered at all, who owns it, which lender is on the RC, and whether fitness and insurance are live. Rs. 99 for the RC check, Rs. 149 with pending challans.

Frequently Asked Questions

Has the Allahabad High Court banned e-rickshaw registration in Lucknow?+

No. On 2 November 2026 the Lucknow bench of the Allahabad High Court, hearing a public interest litigation on traffic congestion, directed the Uttar Pradesh government to decide within four weeks whether fresh e-rickshaw registrations should be restricted in Lucknow and other cities where numbers exceed requirements. The court was told about 1.33 lakh e-rickshaws operate in Lucknow. The decision belongs to the state government, and the matter is listed again on 9 December 2026. Nothing changes for an e-rickshaw that is already registered.

Do e-rickshaws need to be registered if the registration fee is exempt?+

Yes. The Central Motor Vehicles (Sixteenth Amendment) Rules, 2021 exempted battery-operated vehicles from the fee for issue or renewal of a registration certificate. That removed the fee, not the duty to register. Section 39 of the Motor Vehicles Act 1988 still requires every motor vehicle, including an e-rickshaw as defined in Section 2A, to be registered before it is driven in a public place, and the High Court said as much in its 2 November order. An e-rickshaw with no registration number is an unregistered vehicle whatever the dealer said about the fee.

How do I check whether a used e-rickshaw is registered?+

Ask the seller for the registration number printed on the RC and on the plate, and type it into Vahan Verify. The Rs. 99 RC check reads the VAHAN database and returns the registered owner name pattern, registration date, RTO, vehicle class, maker and model, chassis and engine number in part, fuel type, RC status, fitness validity, insurance validity and any financier under hypothecation. If the seller cannot give you a number, or the number returns no record, the vehicle is not registered and you should not pay for it as a registered one.

Can I register an unregistered e-rickshaw after buying it in Uttar Pradesh?+

Only if the vehicle has the documents a first registration needs: the manufacturer's sale certificate (Form 21), the type approval and roadworthiness certificate (Form 22), insurance, and the dealer invoice in your name. Many unregistered totos were assembled in local workshops or sold second-hand without those papers, so they cannot be registered at all. Even a vehicle with full papers may face a wait if the state restricts fresh registrations after the High Court's four-week deadline. Ask the RTO before you pay, not after.

What happens to the value of a registered e-rickshaw if Lucknow freezes new registrations?+

Experience from other cities suggests the price gap between registered and unregistered units widens. When fresh registrations are restricted, an e-rickshaw that already holds a number becomes the only lawful way to add a vehicle in that city, and buyers pay for the number as much as for the vehicle. An unregistered unit loses the one route it had to becoming legal. For a seller holding a registered e-rickshaw with a clean RC, that is a reason to list it with the record visible; for a buyer, it is a reason to confirm the number is real before paying a premium for it.
