A seller in Bengaluru shows you a mid-size SUV, a registration certificate and a bank letter saying the loan is closed. Everything matches. You pay. Weeks later a recovery agent calls, because the loan was never closed, the letter was printed at home and the RC in your hand was made on a machine seized by the police. That is not a hypothetical. It is the case Wilson Garden police in Bengaluru opened in September 2026, and it turns on one fact every buyer can use: the paper can be forged, but the lender entry in the official vehicle record cannot. Read that entry for Rs. 99 before you pay, and the whole scheme falls apart.

What Happened in Bengaluru

As reported by Siasat Daily on 23 September 2026 and News Karnataka on 25 September 2026, Wilson Garden police arrested three men, a 46-year-old from Kengeri, a 37-year-old from Jnanabharathi and a 43-year-old car dealer from Soladevanahalli, for allegedly forging vehicle registration certificates, bank no-objection certificates and the seals of government offices and officials. The seizure list, according to News Karnataka, included fake RCs, an RC-making machine, government-office seals, e-stamp papers, a computer and a printer.

The case began the way most of these cases begin: with a buyer. A resident of Mehboob Layout was offered an SUV over WhatsApp by a dealer he knew, paid a Rs. 20,000 advance by UPI to an associate, and met the dealer near a park in Wilson Garden. He then found that the RC supplied with the car was allegedly fake, and filed a complaint on 3 September. The investigation that followed recovered what News Karnataka described as 10 high-end vehicles and a two-wheeler worth about Rs. 2 Crore; Siasat put the Wilson Garden haul at 11 cars.

The mechanism matters more than the numbers. According to Siasat, the accused bought cars that still carried unpaid loans, produced forged no-objection certificates to suggest the dues had been cleared, and used those forged NOCs to obtain or manufacture counterfeit registration certificates before selling the cars on. Police were still examining whether every vehicle was stolen or simply under loan default, and whether more buyers had been cheated. The probe is ongoing, and the men are accused, not convicted.

The same pattern, twice before in the same city

This is the third Bengaluru case of its kind in three months. The Siasat report also covered an Annapoorneshwarinagar case in which a single accused allegedly approached car owners who could not pay their EMIs, promised to settle the loan and find a buyer, paid them Rs. 1 to 2 Lakh, sold the cars for Rs. 5 to 10 Lakh and vanished without clearing the loans; 14 cars, a goods vehicle, two autorickshaws and six motorcycles worth about Rs. 1.51 Crore were seized.

In late July 2026, as reported by Deccan Herald and News Karnataka, Adugodi police arrested four men and seized eight cars worth Rs. 1.74 Crore after the accused allegedly altered registration numbers, owner details and number plates on cars that still had loans running, then sold them while posing as the owners. We covered a similar racket in Gujarat in our piece on the Rajkot fake hypothecation papers case.

Three cases, one trick. In every one of them the car was real, the seller was persuasive, and the piece of paper that said "loan closed" was the lie. None of the buyers checked the official record before paying. All of them could have, for less than the cost of the UPI advance.

How a Loan-Default Car Reaches the Used Market

A car bought on finance is hypothecated to the lender. Under Section 51 of the Motor Vehicles Act 1988, that hypothecation is entered in the certificate of registration, and it stays there until the lender confirms the loan is discharged and the registering authority removes it. The borrower holds the car and the RC, but the RC says, in a field most people never read, that a bank or NBFC has a charge over it.

The default route runs like this. The borrower falls behind on EMIs. Before the lender's recovery process catches up, the borrower, or a middleman who has bought the car from the borrower for a fraction of its value, puts it on the market. The lender's name is still on the record, so the seller needs a story for it, and the story is a no-objection certificate: a letter on bank letterhead saying the loan is closed and the bank has no objection to the hypothecation being removed. A real NOC takes a closed loan to obtain. A forged one takes a printer and a seal, which is exactly what Wilson Garden police say they seized.

The buyer sees a letter that looks right, pays in full, and takes the car. Then one of three things happens. The buyer goes to the RTO to transfer the car, the RTO reads the hypothecation on the record, and the transfer stops. Or the lender's recovery agents trace the car to the new address. Or, increasingly, the car is simply located by the GPS tracker the financier fitted at the time of the loan and towed, a scenario we described in the GPS repo tracker trap. In each case the buyer has paid full price for a car that the law still treats as security for somebody else's debt. Our tip on what hypothecation means for used car buyers sets out the legal position in more detail.

The One Field the Forger Cannot Touch

Here is the point the Bengaluru cases make better than any guide could. The seller controls every document in the folder. The seller does not control the VAHAN record. That record is held by the registering authority, and the hypothecation entry on it changes only when the lender files a termination, on Form 35 under Rule 61 of the Central Motor Vehicles Rules 1989, and the RTO accepts it. A forged NOC never reaches the RTO, because the forger has no intention of going there. So the record still shows the lender.

When you run the Rs. 99 RC check on a registration number, the report shows the registration status, owner serial number, registration date, registered RTO and state, vehicle class, fitness and insurance validity, blacklist flag, partially masked chassis and engine numbers, and the lender or hypothecation flag. That last field is the one to read first. If it names a financier, the loan is live as far as the record is concerned. If it is blank, the record carries no charge. The Rs. 149 Full Report adds pending challans, which is worth having on any car that has changed hands informally, because the people who sell loan-default cars are not the people who pay their fines.

What the Seller Shows YouWhat the VAHAN Record ShowsWhat It MeansWhat to Do
Bank NOC, dated recentlyNo lender in the hypothecation fieldLoan closed and termination filed. The NOC is probably genuine and in any case no longer needed.Proceed. Verify the RC status and owner serial, then run the challan check.
Bank NOC, dated recentlyLender still namedEither the termination has not been filed yet, or the NOC is not what it claims to be. Both are the seller's problem to fix, not yours.Do not pay. Ask the seller to file Form 35 and show you the updated record, or close the loan at the bank from the sale proceeds in front of you.
Bank NOC, older than about 90 daysLender still namedEven a genuine NOC is commonly treated as expired after 90 days and will need to be reissued before the RTO acts on it.Ask for a fresh NOC from the bank, confirmed on the bank's own helpline, and the termination filed before you pay.
"No loan, bought in cash"Lender namedThe seller is wrong or lying. A cash purchase does not put a financier's name on a record.Walk away unless the seller can produce closure papers from the named lender and have the entry removed first.

The forger's whole business depends on you not opening the record. Every document in the Wilson Garden case was designed to be looked at across a table and accepted. The official record was the one thing the accused could not print, which is why reading it costs Rs. 99 and saves the price of the car.

What a Genuine NOC Looks Like

If the record is clean, the NOC is academic. If the record still names a lender and the seller insists the loan is closed, the NOC is the document you are being asked to trust, so it is worth knowing what a real one contains. Our tip on what an NOC is and when you need one covers the different kinds; for hypothecation removal, look for the following.

  1. The lender's letterhead and an addressee. A real NOC for hypothecation termination is addressed to the Registering Authority of the RTO where the car is registered, not "to whom it may concern".
  2. The loan account number. A forger rarely has a real one. If the number is present, it can be read back to the bank.
  3. The registration number, chassis number and engine number. All three, and all three matching the RC and the plate under the bonnet. The RC check returns the chassis and engine numbers partially masked, enough to compare the visible digits.
  4. The borrower's name. It must match the registered owner on the record. A loan in one name and a car in another is a question, not an answer.
  5. A recent date and an authorised signature. Lenders' NOCs are commonly valid for 90 days from issue, a practice we explained in our piece on the 90-day bank NOC trap. An old NOC is not proof of anything today.
  6. Form 35 in duplicate, signed by the lender. The NOC says the bank has no objection. Form 35 is the actual notice of termination that the RTO acts on. A seller with one and not the other has half a set.
  7. Confirmation from the bank itself. Call the lender's published customer-care number, not a number on the letter, and ask whether the loan account is closed and whether an NOC was issued on that date. A genuine seller will not object.

Once the termination is filed, the entry comes off the record, and that is what you check again before paying the balance. The filing itself can now be done online through the government's citizen portal; we walked through the screens in our Form 35 online guide.

What to Check Before You Pay

  1. Run the Rs. 99 RC check on the registration number before the viewing. Read the hypothecation field first, then the RC status, owner serial and registration date. BLACKLISTED or CANCELLED means walk away. A lender named means the rest of this list applies.
  2. Compare the record with the RC the seller hands you. Owner name, registration date, chassis and engine digits, RTO. The Wilson Garden case involved RCs made on a machine; a counterfeit RC will not match the record in every field.
  3. If a lender is named, do not accept a printed NOC as closure. Confirm with the bank on its own helpline, check the NOC date, and ask for Form 35 in duplicate.
  4. Insist the termination is filed and the record updated before the balance is paid. Pay a token only, and only against a written sale agreement that makes payment conditional on a clean record.
  5. If the seller cannot close the loan, close it for them, at the bank, from the sale price. Go to the lender's branch together. The foreclosure amount is paid directly to the lender, the foreclosure letter and NOC are issued in front of you, and only the balance goes to the seller. Note that foreclosure may carry charges on some loans; our tip on car loan preclosure charges explains when they apply. Agree in writing who bears them.
  6. Run the Full Report for pending challans. A seller who has stopped paying EMIs has usually stopped paying fines too, and unpaid challans can hold up the transfer.
  7. Pay by bank transfer to the registered owner, never to an associate. The Wilson Garden complainant paid his advance by UPI to a third party. Money that goes to someone other than the person on the record is money you cannot trace back to the sale.

If none of this is possible, walk away. A good price on a car with a lender still on the record is not a good price. It is the price of a car you may not be able to register, keep or sell. In Bengaluru's market there is always another SUV. The used cars listed in Bengaluru on VahanBazaar carry a Verified badge with the RC status and lender flag drawn from the record, so the comparison starts with the field that matters.

The lender entry takes two minutes to read

Type the registration number, pay Rs. 99, and see the hypothecation flag, RC status, owner serial and registration date from the VAHAN record before you pay the seller a rupee.

Selling a Car That Was on Finance? Clear the Record First

Honest sellers are the other victims of cases like Wilson Garden, because every buyer who has read about forged NOCs now treats a lender's name on the record as a reason to leave. The fix is simple and it happens before the listing, not after the first enquiry. Close the loan, collect the NOC and Form 35 from the lender, file the termination online, and wait for the record to update. Our guide on selling a car that still has a loan on it covers the order of operations.

Then list it verified. On Sell My Car, type the registration number and pay Rs. 99. The listing is cross-checked against the VAHAN database and carries a Verified badge showing the RC status, registration date, owner count and lender flag from the record. A buyer comparing three similar cars shortlists the one whose record they can already see is clean. On average, based on VahanBazaar listings data, verified listings get about 3x more enquiries, and there is no commission when the car sells.

What This Means for Used Vehicle Buyers

The Bengaluru arrests are a reminder that the documents in a used-car deal are only as good as the people who produced them, and that in a loan-default sale the people who produced them have every reason to lie. The protection is not better eyesight for spotting fake seals. It is the habit of reading the official record before the money moves, because that record is the one thing the seller cannot print. A lender's name in the hypothecation field is not a detail to negotiate around. It is a stop sign until the entry is gone.

For buyers in Bengaluru or any metro, the sequence is short: run the Rs. 99 RC check on the registration number, read the lender field, compare the record with the RC in the seller's hand, confirm any NOC with the bank directly, and pay the balance only when the record is clean. If the seller cannot get there, the car is not for you.

This article is general information and not legal advice. Case details are as reported by the outlets named and relate to allegations under investigation; the accused are presumed innocent until proven guilty. NOC validity, Form 35 processing and transfer procedures vary between lenders and RTOs; confirm the requirements with your lender and your RTO before you buy or sell.

Read the Lender Field Before You Pay

The Rs. 99 RC check shows the hypothecation flag, RC status, owner serial and registration date from the VAHAN record. The Rs. 149 Full Report adds pending challans. Two minutes, no seller paperwork needed.

Frequently Asked Questions

Can a bank NOC for a car loan be forged?+

Yes. In September 2026, Wilson Garden police in Bengaluru arrested three men for allegedly forging bank no-objection certificates, registration certificates and official seals to sell cars that still carried unpaid loans. A printed NOC is a piece of paper and can be copied. The hypothecation entry in the VAHAN record is held by the registering authority and is only removed when the financier's termination is filed and accepted, so it is the entry to read before you pay.

How do I check if a used car still has a loan on it?+

Read the VAHAN record for the registration number. If the hypothecation or financer field names a bank or NBFC, the loan is still recorded against the car as far as the RTO is concerned, whatever paper the seller shows you. The Rs. 99 RC check on VahanBazaar returns that field along with the RC status, owner serial, registration date, blacklist flag and fitness and insurance validity. The Rs. 149 Full Report adds pending challans.

What should a genuine bank NOC for hypothecation removal contain?+

A genuine NOC is on the lender's letterhead, addressed to the registering authority, and carries the loan account number, the registration number, the chassis and engine number, the borrower's name, the date of issue and an authorised signature. It usually comes with Form 35 signed by the lender in duplicate and a loan closure or foreclosure letter. Lenders' NOCs are commonly valid for 90 days from issue. Confirm the certificate with the bank on its own helpline or at the branch before relying on it.

What if the car I want still shows a financer on the RC?+

Do not pay the seller directly. Either walk away, or structure the deal so the loan is closed from the sale proceeds at the bank, with the foreclosure letter and NOC issued in front of you and the hypothecation termination filed before the balance is paid. The transfer into your name cannot be completed while a lender is recorded, and a lender whose loan was never closed can still pursue the vehicle.
