Two small boxes decide whether a used commercial vehicle can earn money. One limits how fast it can be driven. The other reports where it is, and carries an emergency button a passenger or driver can press. Neither is visible in a photograph, neither improves the drive, and neither is something a seller volunteers. Yet a missing, uncertified, unsealed or unactivated device is one of the few faults on a commercial vehicle that stops it working entirely, because it fails the vehicle at the fitness lane and blocks the permit behind it. This guide sets out which vehicle classes actually need each device, which are genuinely exempt, how to inspect both on a used vehicle, what paperwork to demand, and why the class on the record is the only version of the truth the RTO will act on.
Before You Start
Three things before you look at a single listing. First, settle what class of vehicle you are actually buying, because every rule below hangs off that and nothing else. A vehicle described as a goods carrier, a staff bus or a tourist cab may be registered as something quite different, and a rebuilt body does not change what the RTO reads on its screen. Second, ring your own RTO or your state transport department and ask, for that exact class, whether a speed limiting device is required and at what preset speed, and whether a tracking device is required. Central rules set the frame, but the retro-fitment categories and the enforcement practice are set state by state, and they have changed more than once. Third, budget time, not just money, because getting a non-compliant vehicle back to a state where it can be inspected is measured in weeks off the road, not in a single afternoon at a workshop.
Pro Tip: The seller's photographs almost always show the registration number. That is enough to pull the registered vehicle class, registration date, fuel type, RC status, fitness position and any blacklist or challan flag from the VAHAN database before you travel anywhere. 1. What a Speed Limiting Device Actually Is, and Who Must Have One
A speed limiting device, commonly called a speed governor, is a unit that prevents the vehicle being driven above a fixed preset speed. It is governed by Rule 118 of the Central Motor Vehicles Rules 1989, and the device must conform to the Automotive Industry Standard AIS-018. The rule also requires that the device be capable of being sealed with an official seal of the State Transport Authority or a Regional Transport Authority, in such a way that it cannot be removed or tampered with without the seal being broken. That sealing requirement is the single most useful thing a buyer can know, because the seal is a physical object you can look at with your own eyes on the vehicle in front of you.
Rule 118 as amended in April 2015 works to a preset of 80 km/h for the notified transport vehicle categories manufactured on or after 1 October 2015, with a lower preset of 60 km/h for dumpers, tankers, school buses and transport vehicles carrying hazardous goods. Buses used to carry passengers within airport premises are set far lower again under sub-rule (3). For vehicles registered before October 2015, sub-rule (2) leaves it to State Governments to notify the categories that must be retro-fitted, which is exactly why two operators in neighbouring states can have opposite answers for the same model of vehicle.
The exempting proviso is short and worth memorising. It names two-wheeled and three-wheeled transport vehicles, quadricycles, fire tenders, ambulances and police vehicles, and it also excludes any transport vehicle verified and certified by a testing agency specified in Rule 126 to have a maximum rated speed of not more than 80 km/h, on the sensible logic that a vehicle that cannot reach the cap does not need a device to stop it. Separately, and importantly, Rule 118 is a rule about transport vehicles. A privately registered white-plate car sits outside it entirely, which is one reason an ex-taxi converted back to private registration is a different animal from the yellow-board version of the same car.
Where states diverge: MoRTH has issued an advisory on the power to exempt certain categories of vehicles from fitment of a speed governor, and states have used that power in different directions over the years, with lighter passenger classes both gaining and losing exemptions. Treat any blanket claim about "all commercial vehicles" with suspicion, and confirm the current requirement for your vehicle class with your RTO or a qualified transport consultant.
2. What a VLTD and Emergency Button Are, and Who Must Have Them
A vehicle location tracking device, or VLTD, continuously reports the vehicle's position to a state monitoring centre, and it is paired with one or more emergency buttons that raise an alert with the vehicle's location when pressed. The requirement sits in Rule 125H of the CMVR 1989, inserted by G.S.R. 1095(E) dated 28 November 2016 and made effective from 1 April 2018, and the specification, testing and certification follow AIS-140:2016. Rule 125H applies to public service vehicles as defined in clause (35) of section 2 of the Motor Vehicles Act 1988, and the rule expressly does not apply to two-wheelers, three-wheelers or e-rickshaws.
That definition is where most confusion begins. A goods truck is not a public service vehicle, so an ordinary goods carriage is not brought in by Rule 125H alone. Goods vehicles were pulled in by separate notifications instead: national permit vehicles from G.S.R. 1081(E) dated 2 November 2018, and vehicles carrying dangerous or hazardous goods from G.S.R. 617(E) dated 3 August 2022. So the honest answer to "does my truck need a tracker" is a question in return: is it running on a national permit, or does it carry hazardous goods? If neither, the central requirement does not reach it, though your state may still have its own conditions attached to particular permits.
The emergency button is not a formality either. Under the fitment procedure states follow, a passenger car must have at least one emergency button on each passenger row plus a dedicated button for the driver; a passenger bus must have buttons positioned so every passenger can reach one, with dedicated buttons for rows reserved for ladies; and national permit trucks must have one dedicated button within easy reach of the driver. The device itself must be mounted where passengers cannot easily reach or interfere with it, with no metal shielding over it, and its IMEI number must be clearly marked so an inspector can read it without dismantling anything.
3. The Exemption Map: Which Devices Your Vehicle Class Actually Needs
This is the table to read twice. Everything in it turns on the vehicle class as recorded on the RC and in the VAHAN database, and every line comes with the same health warning: implementation and enforcement vary by state even where the central rule is uniform, so treat this as the map, not the territory, and confirm the position for your own vehicle with your RTO.

Two lines in that table deserve a second look, because they are where money is lost. The first is the motor cab row: a small taxi is a public service vehicle, so the tracking device and emergency button question is settled, while the speed governor question is genuinely state-dependent. The second is the light goods carriage row, because a great many small pickups change hands every month on the assumption that "commercial means governor", and the seller's assumption is as likely to be wrong as yours. 4. How to Inspect Both Devices on a Used Vehicle
Start with the speed limiting device. Ask the seller to show you where it is fitted and let you photograph it. You are looking for three things: an official seal that is present and unbroken, a device serial number that you can read, and a set speed that matches the class of the vehicle. A device with a seal that has been cut, re-glued, painted over or replaced with something that is not an official seal is a finding, whatever explanation follows it. Then take the vehicle out with the seller and see whether it behaves as a governed vehicle behaves. A vehicle that pulls comfortably past its class cap on an open stretch is telling you something the certificate is not.
For the tracking device, the physical inspection is quick and the electronic one is the real test. Physically, the unit should be mounted out of easy reach of passengers, with no metal cover over it and its IMEI clearly marked above the device. The wiring to the device and to the buttons should be shielded, coupled and tucked away, with nothing hanging loose. The emergency buttons should be where the fitment rules put them, firmly mounted, and wired rather than decorative. A button that moves in its housing, or that has clearly been added later with no wiring behind it, is a dummy.
Then ask the one question that separates a compliant vehicle from a cosmetically compliant one: show me this vehicle live. An operator running a genuinely activated device can log in and show you the vehicle's current position and health status. A seller who cannot, or who says the connection "will be sorted after the sale", is telling you that the device has not been registered and activated with the state monitoring centre, which is the part that actually counts. Under the fitment procedure states follow, the device also needs an active cellular plan, and older vehicles are typically expected to carry a shorter minimum validity than newer ones, so ask when the plan expires and who pays to renew it.
5. The Certificates and Paperwork to Demand From the Seller
Verbal assurances are worthless here, because the RTO will not ask the seller anything. Ask for documents, in this order, and refuse to move money until you have looked at them alongside the vehicle.

One caution on the fitment certificate for the speed limiting device. It is issued against a specific vehicle and a specific device, and the seal number on it is the link between the paperwork and the metal. If the seal on the vehicle carries a different number from the certificate, the device on the vehicle is not the device on the certificate, and you should stop there. Confirm the Class Before You Chase the Certificates
Registered vehicle class, registration date, fuel type, RC status, fitness position, blacklist and challan flags — from the number plate, before you travel.
6. How to Spot a Tampered or Bypassed Device
This section is about recognition only. If you find any of the signs below, the correct response is to walk away from the vehicle or to have it put right by an approved fitment agency before the sale completes. Do not attempt to interfere with, restore or adjust either device yourself, and do not accept a seller's offer to "set it right" outside the approved channel, because a device that has been worked on off the record is a fresh problem wearing the old one's clothes.
Signs worth stopping for
The seal is broken, missing, re-glued or unofficial. Rule 118 specifically contemplates a seal that cannot be removed without being broken, so a compromised seal is the whole point of the rule failing in front of you.
Serial numbers do not match. The device serial on the vehicle differs from the fitment certificate, or the IMEI on the tracking unit differs from the paperwork.
The certificate names another vehicle. A fitment certificate with a different registration or chassis number is not evidence about this vehicle at all.
No live data. The tracking unit is present but the seller cannot show a current position or health status, which usually means it was never activated with the state monitoring centre.
Cosmetic emergency buttons. Buttons that are loose, painted over, missing from rows where the rules place them, or fitted with no wiring behind them.
Fresh, untidy wiring near either unit. Re-run, exposed or hanging wires around a device that should have been factory-tidy at fitment.
The vehicle exceeds its class cap on a test drive. Whatever the certificate says, a governed vehicle behaves like a governed vehicle.
An expired SIM or an unlisted device model. Both fail at inspection, and both are quietly expensive to fix after you own the vehicle.
A line not to cross: Interfering with a speed limiting device or a tracking device is not a grey area, and this guide deliberately explains only how to recognise interference, never how to perform it. A vehicle offered to you with either device disabled is being offered in a condition it cannot legally work in, and inheriting that condition makes it your problem the moment the registration changes hands.
7. How a Missing Device Blocks Fitness and Permit Endorsement
Here is the mechanism that turns a small box into a stopped business. A transport vehicle is validly registered only while it holds a certificate of fitness under section 56 of the Motor Vehicles Act 1988, and it may only be used on a permit under section 66. Both are checkpoints, and both are where these devices are examined. Under the standard state operating procedure for tracking devices, the state enforces the fitment and functional status of the device at registration, at permit issuance, at renewal and at the fitness check, through VAHAN and through the state monitoring centre. The speed limiting device is checked in the same lane, as part of the same inspection that looks at brakes, tyres, lights and the rest.
The electronic half of this is what catches honest buyers. A tracking device only counts once its type approval is recorded on VAHAN, the unit is tagged to that chassis, and the state monitoring centre has established connectivity, verified the emergency button and pushed the activation back to VAHAN, at which point the fitment certificate can be generated. A unit sitting behind the dashboard with no backend record is, for the purposes of the inspection, not fitted. That is why "the device is there, saab" and "the device is compliant" are two entirely different statements.
Enforcement has also tightened. On 13 May 2026, in S Rajaseekaran v. Union of India, the Supreme Court noted that fewer than one percent of transport vehicles were carrying compliant tracking devices and emergency buttons, directed States and Union Territories to ensure retro-fitment in public service vehicles registered up to 31 December 2018, and directed that no public service vehicle be granted a fitness certificate under section 56 or a permit under section 66 unless the installation is verified and reflected on the VAHAN database. Whatever the practice was in your district last year, the direction of travel is one way. If you are buying a passenger vehicle that has been off the compliance radar, price that in. Compliance blockages of this kind are cumulative rather than isolated, which is also why an unrelated liability such as an unpaid toll balance can hold up an NOC, fitness or permit.
8. What Buying Blind Actually Costs You
The cost of getting this wrong is almost never the device. It is the calendar. A commercial vehicle that cannot clear fitness cannot legally work, and a vehicle that cannot work still carries its instalment, its parking, its insurance and, if you have already committed to a route or a contract, a customer expecting a service you cannot provide. Add the inspection appointment, the fitment appointment, the wait for the activation to reflect, and the second trip to the testing lane, and a problem that looked like an afternoon becomes a month. Meanwhile the leverage you would have had in the negotiation, when the seller still wanted your money, is gone.
Check before you pay
You know the class, you know which device is required, and any gap becomes a line item the seller either fixes or funds before the transfer.

Fitment, approval, activation and re-inspection all happen on your bill and on your time, with the vehicle earning nothing throughout.
There is one piece of live policy worth knowing, clearly labelled for what it is. In August 2026 MoRTH issued a draft notification proposing to amend Rule 88 of the CMVR 1989 to extend the permissible operating age of vehicles under the national permit system for battery, hydrogen and natural gas powertrains, from 12 and 15 years to 17 and 20 years respectively, with the extension not proposed for diesel and petrol vehicles. Objections and suggestions were invited for 30 days. That is a proposal open to consultation, not law, and nothing in it changes any device requirement described above. Common Mistakes Indian Buyers Make
Avoid these eight mistakes: every one of them is a version of trusting a description instead of a record, and every one of them is cheaper to avoid than to unwind.
- Assuming that "commercial vehicle" automatically means both devices are required. The obligation follows the registered class, and several classes are genuinely exempt from one device or both.
- Assuming the opposite, that a small taxi or light pickup needs nothing, when a motor cab is a public service vehicle and states differ on the speed governor question for lighter classes.
- Accepting a tracking device that is physically fitted but never registered and activated with the state monitoring centre, which is the single most common failure on used passenger vehicles.
- Taking a fitment certificate at face value without matching the registration number, chassis number, device serial and seal number against the vehicle standing in front of you.
- Ignoring the SIM behind the tracking device, then discovering after purchase that the plan lapsed and the device has been offline for months.
- Treating a broken or missing official seal on the speed limiting device as a small workshop job rather than as a fitness failure and a reason to renegotiate or walk.
- Believing a seller who says the paperwork "will come after the transfer". Once the RC moves, every remaining problem is yours, and your leverage has gone with your money.
- Relying on what a neighbouring state does. These rules are centrally framed but state-implemented, and the answer that applies is your own RTO's answer.
Real Indian Example
Consider a small operator in Coimbatore looking at a tourist maxi cab of around 2017 vintage, offered by a seller winding down a route. The vehicle presents beautifully. Tyres are good, the interior has been redone, the seller has service records and a photograph of a fitness certificate on his phone, and the price sits below anything comparable in the district. He is asked to demonstrate the tracking device on his operator screen and cannot; he explains that the connection "stopped some time back" and that the unit itself is perfectly fine.
What that sentence actually means is that the device has not been reporting to the state monitoring centre. On a public service vehicle, that is not a background irritation. It is the thing that stands between this vehicle and its next fitness certificate, and therefore between the buyer and any lawful earnings from it. A closer look finds the second half of the story: the emergency button on one passenger row is loose in its housing, and the speed limiting device carries a seal number that does not appear anywhere on the fitment certificate the seller produces.
The buyer's options at that point are simple and all of them are better than paying. He can require the seller to have both devices put right through approved fitment agencies, re-registered and re-activated, and the vehicle re-presented for inspection before any money moves. He can renegotiate on the basis of a written estimate obtained from an approved fitment agency in his own city, rather than a number either party invents. Or he can walk, which on a vehicle whose compliance history is this untidy is often the sound commercial answer. What he must not do is buy on the assumption that a device which is physically present is a device that will pass, because the record disagrees, and at the testing lane the record wins.
The whole episode was avoidable for the price of a VAHAN check and one honest question. The check would have shown him the registered class and the fitness position before he drove across the district; the question would have shown him the device was dead before he made an offer.
Final Thoughts
Speed limiting devices and vehicle location tracking devices are the two most under-inspected items on the used commercial vehicle market, and they are also two of the very few faults that stop a vehicle working outright rather than merely costing money to fix. Everything else on a truck or a bus can be repaired around a working schedule. A vehicle that cannot get a fitness certificate cannot work at all, and no amount of new tyres or fresh paint changes that.
The discipline that protects you is unglamorous and takes ten minutes. Establish the registered class first, because that is what decides whether either device is required. Ask, for that exact class in your own state, what the requirement actually is, and get the answer from your RTO or a qualified transport consultant rather than from the seller, the broker or a WhatsApp group. Then inspect the device, match it to a certificate that names this vehicle, and make the seller show you the tracking unit alive on a screen. If any of those three steps fails, you have not lost a deal; you have found the reason the deal was priced the way it was.
And read the record before you do any of it. The registered vehicle class is the fact the whole chapter hangs on, it is the one fact the seller cannot edit, and it is available against the number plate for Rs. 49.
