A private car has to start, stop and suit its owner. A commercial vehicle has a harder job: it has to be legally allowed to earn. That is the only test that matters when you are buying a second-hand tipper, goods pickup, school van or national-permit truck, and it is a different question from whether the engine sounds sweet on a cold morning. In 2026 part of that answer lives inside a small sealed box behind the dashboard, transmitting the vehicle's position to a server you will never see. If that box is dead, uncertified, disconnected or never linked to this registration number, the vehicle can sail through your walkaround and fail its fitness renewal weeks after your money has changed hands.
What AIS-140 Actually Requires
AIS-140 is an Automotive Industry Standard notified by the Ministry of Road Transport and Highways, covering intelligent transport systems for public and commercial transport. Its core requirement is a Vehicle Location Tracking Device, or VLTD, fitted and working.
A compliant VLTD has to do three things: fix the vehicle's position using GPS and NavIC, India's own satellite navigation system; carry one or more physical emergency or panic buttons; and transmit location data in real time, at defined intervals, to a certified backend server. The device cannot be bought off a shelf. It must be certified by ARAI or another approved testing agency before sale or installation.
Fitment is mandatory for most public service and national-permit commercial vehicles, which sweeps in much of what trades second-hand: goods carriers on national permits, tippers, staff and school buses, vans, contract carriages, maxi cabs and yellow-board taxis. State RTOs enforce it at three moments: registration, fitness renewal, and permit issue or renewal.
What the box physically is, and where it sits
Most buyers have never consciously looked at one. A VLTD is a small plastic-cased unit, roughly the size of a paperback, with an aerial lead, a wiring loom into the ignition supply and thin wires to the panic buttons. It sits out of sight behind the dashboard, above the fuse box, under the co-driver seat or inside a trim panel. That arrangement is why the problem is invisible. You can see a tyre and hear a turbo. You cannot see a subscription, a certification or a server-side mapping, and none leaves a mark on the vehicle.
What Changed in 2026 Is Enforcement, Not the Rule
It is worth being precise, because much of the talk in the market treats this as a fresh burden. It is not a new rule. AIS-140 has been in force for years, enforced by state RTOs at registration, fitness renewal and permit issue or renewal.
What has changed is how tightly that enforcement is wired into the national record. Many state transport departments now link AIS-140 compliance to the fitness certificate through the VAHAN ecosystem, and VLTD compliance is verified in real time through VAHAN at checkposts and toll booths. The standard is doing exactly what it was designed to do. The difficulty for a used-vehicle buyer is that the system now notices things quickly, and notices them at the counter rather than the kerbside.
A second change compounds it. From 1 October 2024 all commercial and transport vehicles must undergo fitness testing exclusively at Automated Testing Stations, and ATS results upload directly to VAHAN, as our explainer on the ATS fitness test for a used commercial vehicle describes. Fitness is now assessed by instruments rather than by eye, and the result lands in the record automatically.
The standard exists for a good reason. Tracking and panic buttons are a passenger-safety measure on public service vehicles and a traceability measure on goods vehicles, helping recover stolen loads and stolen trucks. The point here is narrower and entirely about the second-hand market: a vehicle's compliance position travels with the vehicle, and the buyer is usually the last person to find out what it is.
What It Costs to Get This Wrong
The consequences of non-compliance are not a single fine. They are a stack, and they hit an operator where it hurts: uptime.
Refusal of fitness certificate renewal comes first, and it stops the vehicle dead, because without a valid fitness certificate a transport vehicle cannot legally work. Suspension or cancellation of transport permits can follow, and a permit problem is worse because it is slower to unwind. On top sit state-dependent fines ranging from Rs 5,000 to Rs 20,000 or more, on-the-spot detention at checkposts, and show-cause notices for aggregators. For school transport, suspension of school bus permits is on the table, so a vehicle bought to run a school contract can lose the contract along with the permit.
Read that list as a buyer and the risk is obvious. None of it reduces the vehicle's value as a machine. It reduces the vehicle to zero as a business asset for as long as it lasts, and a tipper sitting in a yard still costs the same instalment every month.
The timing is the cruel part. These consequences surface at the next fitness renewal, permit renewal or checkpost stop, not at the sale. A vehicle can be sold in September, run perfectly through October, and become an expensive paperweight in November when it presents for fitness. By then the seller is gone and the problem is yours.
The Four Ways a VLTD Fails on a Second-Hand Vehicle
A new commercial vehicle leaves the dealer with a certified device, a live connection and a correct mapping. Everything after that is wear, economy and workshop convenience. Four failure modes are worth naming.
1. The device was removed, or swapped for a unit that was never certified
Certified hardware costs more, and when a device fails in service the cheapest fix in front of a busy operator is often a generic tracker from the market. That replacement may work perfectly well and still not be a certified device, because certification by an approved testing agency is a requirement in itself, not a description of capability. A vehicle can be tracked, visible on somebody's screen, and non-compliant at once. A device can also simply have been pulled out during a cabin rebuild and never refitted.
2. The connectivity or subscription behind it has lapsed
This failure catches the most buyers, because it is silent. The unit needs a live data connection to reach the backend server, and that connection is a paid service. An operator winding down or preparing to sell has little incentive to keep paying. The box still has power and shows a light. It transmits nothing. From the driver's seat, a lapsed unit and a working one are identical.
3. The panic buttons have been disconnected
Emergency buttons are wired separately, through exactly the areas disturbed on a working vehicle: cabin trim, seat mounts, bus and van interiors, body rebuilds. A button unplugged during a repair and never reconnected is a compliance failure even when location data is flowing, and on a school bus it is the part that matters most to the people in the back.
4. The device is genuine but never mapped to this registration number
The most frustrating version, because everything physical is correct. A certified device is fitted, powered and transmitting, but the backend record does not associate it with this registration number, either because the mapping was never completed at installation or because it broke later. The vehicle has no usable compliance position despite working hardware, and this surfaces only when somebody queries the record.
Notice what all four have in common. None is visible on a test drive, an engine inspection, a load test or a walkaround, and three of the four are invisible even to the driver. This risk has to be handled on paper and on screen, before the money moves, rather than in the yard with a torch.

The Fitness and Permit Cliff You Inherit
Here is the part small operators underestimate. Buying a used commercial vehicle is not buying a clean slate. It is buying a position on a timeline somebody else set, and the closer the next fitness or permit renewal, the more of the previous owner's problem you have taken on.
With ten months of fitness left, a tracking problem is an irritation you can fix at your own pace. With five weeks left it is an emergency, because you are presenting the vehicle at an ATS while arranging a certified device, a live connection and a correct mapping. The vehicle is identical in both cases. Only the date differs, and the date is knowable before you pay.
Permits behave differently from fitness. Permit status is not a simple renewal counter and it interacts with ownership in ways that surprise first-time commercial buyers, as our piece on why permits do not simply transfer with a used truck sets out. Dues matter too, since pending challans can hold up permit and fitness work, as covered in how challans now freeze truck permits. Age adds a third clock, and on national permits there is a hard age cliff worth knowing before you shop.
Stack those clocks together and you have the real picture: fitness validity, permit status, age against any cap, and outstanding dues. A tracking problem is dangerous mainly because of where it lands on those clocks, and every one of them can be read from the record.
What to Check Before You Pay
The sequence below runs cheapest first, so each step can end the conversation before you spend on the next. That matters more on commercial vehicles than on cars, because the distances travelled to view a truck are longer and the deposits larger.
- Pull the VAHAN record against the registration number first, before you travel, inspect or pay a deposit. - Read the fitness and permit dates as a countdown, not a status. Treat anything under a couple of months as a cost you are taking on, not a detail.
- Ask for the device certificate and the mapping paperwork. The certificate from ARAI or whichever approved testing agency certified the model proves the device is approved. The installation and mapping record proves this box was fitted to this vehicle and registered against this number. A seller who has never heard of either has told you something useful.
- Ask for a live transmission check in front of you. The operator can open the tracking portal and show the current position and the last transmission timestamp. That timestamp is the most useful thing you will see, because it rules out the silent subscription lapse.
- Press every panic button while somebody watches the portal, including those in the passenger area on a bus or van. They are the part most likely to have been disconnected during a repair.
- Confirm the vehicle class and permit category on the RC match the work you intend to do, because a vehicle bought under one category cannot simply be redeployed to another. Reading the vehicle class on an RC shows how.
- Get the compliance answer in writing before the deposit — a message you can point to later naming the device, its certification and its live status, not a verbal assurance in a yard.

Where a Photo-Based Condition Read Stops
It is worth being straight about the limits of the other tool in the kit. On a used commercial vehicle that is genuinely useful: body and chassis evidence, panel and paint inconsistency, tyre condition, load-bed state, signs of a heavy repair. So the division of labour is clear. The record check answers the legal question, including the expiry dates. The seller's certificate and a live portal check answer the tracking question. The mental model that serves a small operator best is this: you are not buying a vehicle, you are buying a stream of legal earning days. Anything that can interrupt that stream is part of the price, whether or not it appears in it. A dead tracking device does not show up in a walkaround, a test drive or a load test. It shows up at the fitness counter, the permit window or a checkpost, and by then the vehicle is yours: invisible where buyers instinctively look, readable in the place most buyers skip.
The fix is neither complicated nor expensive. Spend Rs 49 on the record before you travel, or Rs 79 for the RC and challan checks together, and read the fitness and permit dates as a countdown rather than a tick. Then ask three questions about the tracking unit: is there a certificate from an approved testing agency, is there a mapping record against this registration number, and can you show a recent transmission on the portal right now. Press the panic buttons yourself, and take the answers in a message rather than a handshake.
None of that needs a specialist. It takes twenty minutes and the price of a meal, against a vehicle that will carry your instalments for years. On a transport vehicle the paperwork is part of the machine. The engine decides whether it runs; the record decides whether it is allowed to.
